We at Fresh Start Family & Divorce Mediation (“FSFDM”) know that privacy is a major concern of visitors to our web site (“Site”). This policy describes the personal information we collect on our Site, in our corporate offices, and partner offices operating under the Fresh Start Family & Divorce Mediation ® name, how we, our employees and partners use it, and when we, our employees and our partners share it with third parties.

Our Business Structure
The Fresh Start Family & Divorce Mediation® name, design, logos and related marks are registered pending trademarks of FSFDM or its affiliates. The Fresh Start Family & Divorce Mediation® offices are owned and operated  by Fresh Start Divorce Solutions Ltd.  FSFDM, a corporation incorporated pursuant to the laws of Canada, conducts business under the name of Fresh Start Family & Divorce Mediation in partnership with independent partners (ie lawyers, mediators, financial services etc.) to provide Fresh Start Family & Divorce Mediation® products and services to the public. This Site is presented by FSFDM. Fresh Start Family & Divorce Mediation® assumes no responsibility or liability for the privacy practices of our independent partners  in their handling of your personal information they may collect from you online or offline.

What Is Personal Information?
Personal Information is defined as “information about an identifiable individual, but does not include the name, title or business address or telephone number of an employee of an organization.” In other words, it is information particular to an individual that would allow him or her to be identified. This would include your name, residential address, e-mail address(es), telephone number, and personal financial information. We also collect information when a client engages in a Divorce Consultation, the manner and amount of the client’s retainer, when a client file was opened and closed, and certain other information that will allow our network of employees and our Corporate partners to improve our systems and delivery.

Why We Collect Personal Information
FSFDM and its employees and partners collect personal information in order to facilitate the services that are offered through our network of employees and our partner offices to our respective clients. FSFDM also collects Personal Information about its employees and partners, for example, to determine their credit-worthiness or for the preparation and/or registration of documents needed confirm licensing, credentials and legal registration of an individual. FSFDM, its affiliated partners and its employees may put Personal Information to a variety of uses, which may include invoicing client accounts as appropriate; communicating information and offers to clients; to better understand, analyze, and respond to our clients’ needs and preferences, and to subsequently develop, enhance, and/or provide products and services to meet those needs.

Consent
We try to ensure that you understand how FSFDM, its employees and partners use your Personal Information. One of the ways this is done is by obtaining your consent. Consent may be either express or implied. Express consent is given when we specifically ask you if it acceptable to you that we gather certain information and you explicitly agree that it is. Implied consent occurs when you provide information that may be Personal Information without objection. As we obtain only the information necessary to assist you with the transaction you require, we operate under the understanding that you have agreed to provide us with this Personal Information voluntarily and with knowledge of this Policy whenever you do so.

Use and Retention of Your Personal Information
We will retain your Personal Information for as long as we provide or may potentially provide services to you. When your Personal Information is no longer necessary to FSFDM,  its employees and partners for the purposes described in this Policy, it will be destroyed, erased, or de-personalized. The only exception to this will be where we may be required to keep or provide your Personal Information as a result of legislation, as required by law or government regulation, or due to a court order.

No Sharing, Selling, or Bartering of Your Personal Information
Your Personal information is not given, rented, or sold to any third party for any reason. It may be combined with other Personal Information collected by FSFDM, its affiliates or employees to provide aggregate statistical information about clients’ service usage preferences, but at no time will your Personal Information be shared with any other parties that might be involved in this aggregate collection of Information

Site Usage Information
Like most web sites, this Site gathers traffic patterns, site usage information and other aggregated data in order to evaluate our visitors’ preferences and the effectiveness of our Site. This aggregate usage data does not identify you individually. We may share anonymous, aggregated statistics about visitors to our Site with others outside our company, or we may allow third-parties to collect aggregate data through our Site. Our web does use cookies or web beacons.

Access
FSFDM, its employees and partners  will advise you on request about what Personal Information about you that we have collected, as well as how it has or will be used. If you provide a written request for this information, we will provide it to you within a reasonable time following confirmation of your identity and may charge a reasonable cost (e.g. photocopying, mail charges) to the individual making the request. We will inform you whether or not we hold Personal Information about you and, when possible, the source of the Information, its use, and any parties to whom it may have been disclosed. You may be required to provide sufficient proof of your identity at this time to ensure the safety and security of the Information we hold and that it is provided to individuals in accordance with this Policy. FSFDM, its affiliates or employees reserve the right to decline to provide access to Personal Information where the information requested would disclose: Personal Information of another individual or of a deceased individual; is not readily retrievable and the burden or cost of providing would be disproportionate to the nature or value of the information; does not exist, is not held, or cannot be found by RCGA; could reasonably result in serious emotional harm to the individual or another individual, or serious bodily harm to another individual; or may harm or interfere with law enforcement activities and other investigative or regulatory functions of a body authorized by statute to perform such functions. FSFDM, its affiliates or employees will not respond to repetitious or vexatious requests for access.

Security of Your Personal Information
FSFDM operates secure data networks protected by industry standard firewall and password protected systems, and maintains physical, electronic and procedural safeguards to guard the integrity and privacy of these servers and of your Personal Information. Although we can’t guarantee that there will never be a security problem, we and our employees  that have access to your information carefully guard against the loss, misuse or alteration of the information we collect on our Site.

Changes in Our Privacy Policy
We reserve the right to change our Privacy Policy from time to time — for example, by altering our policy on sharing personal information. Be sure to check this page periodically for updates.

Governing Law
FSFDM controls and operates this Site in Canada. Our online privacy practices are governed by the laws of Canada and Ontario, which may differ from privacy laws in your province, state or home country. By submitting your personal information to this Site or to a Fresh Start Family & Divorce Mediation® franchisee, you consent to the transfer of your personal information to any country and its use and disclosure in accordance with Canadian federal and Ontario law and with this Privacy Policy.
